Under Massachusetts Law, tenants under lease have no right to sublet their apartments without the landlord’s consent. This is also restated in your lease. Occasionally, due to company transfer or other reason, tenants request that they be let out of their leases. If this is your situation, we will attempt to accommodate you on the following terms and conditions:
We will list the apartment with the Brokers we normally use and give them access for showing at all reasonable times.
You will give us as much written notice as possible as to your move out date (30 day should be the minimum).
You will keep your rent current until you vacate.
You will be charged a fee equal to one half months rent to Main Street Realty to compensate us for the work we do in re-renting your apartment. You will also promptly pay the broker any fee due them for their services in re-renting the apartment (typically a half to a full month’s rent). The fee to Main Street Realty will be deducted from your last months rent or security deposit along with any costs incurred to repair any damage to the apartment or paint touch-ups, as needed, and any balance will be forwarded to you to the new address you provide us.
Under your lease and Massachusetts Law, you are responsible for the rent for the apartment until an acceptable new tenant is found and begins paying rent.
The termination agreement form
must be filled out and signed by any tenants residing in the unit who wish to terminate their lease.
